The Offence:
A person is guilty of using (our italics) a motor vehicle without third party insurance. A person is also guilty of permitting a vehicle to be used without insurance. A person who uses, or allows a vehicle to be used without insurance, does not have to know that the vehicle is uninsured or intend to drive without insurance.
The Penalty:
A person using a vehicle without insurance will have their licence endorsed with between six and eight points and receive a financial penalty. A person who is now involved in a fatal accident whilst uninsured faces imprisonment and a disqualification.
How we can help:
We can help if a conviction for this offence will result in the accumulation of 12 or more penalty points. In such a case you will be a totter and your licence will be at stake.
There are a limited number of cases in which a person who uses a vehicle whilst uninsured has been misled into believing they were insured. Whilst still technically guilty of the offence it mat be possible to avaoid endorsements or disqualification by arguing that "Special Reasons" exist.
Legal aid is not available for an offence of this nature.
