The Offence:
A person is guilty of an offence if he drives without due care and attention or without reasonable consideration. For a prosecution to succeed it has to be proven that the driver departed from the standard of a reasonable, prudent and competent driver in all the circumstances of the case.
The Penalty:
The magistrates court is limited in the imposition of a financial penalty in these cases. In addition the driver will receive endorsements of between three and nine points, or in more serious cases an immediate disqualification.

Whilst the court has limited powers of sentence we do think there are occasions when it is important to be advised and represented by a solicitor, particularly if you already have licence endorsements and run the risk of disqualification. Whilst legal aid is rarely available, the cost of engaging a solicitor is often more cost effective than losing your driving licence.
